Whilst many minor developments can proceed under permitted development rights, more significant developments that may affect local amenity, human health or the environment, require a formal approval by the Local Planning Authority (LPA) before any development can take place. For larger or nationally significant developments, such as major infrastructure projects, energy facilities, or large-scale developments, approval may be required though the Development Consent Order (DCO) process. This process is managed by the Planning Inspectorate (PINS), who produce a report with recommendations for the relevant Secretary of State who then makes a decision on whether to grant consent.

Do I need planning permission?
Planning permission is required for any activity constituting "Development". This is defined in the Town and Country Planning Act 1990 as "the carrying out of building, engineering, mining or other operations in, on, over or under land, or the making of any material change in the use of any buildings or other land".
Whilst some minor developments may fall outside of the planning process, or be able to proceed under permitted development rights, more significant developments that have the potential to affect local amenity, human health or the environment, require permission before any development can take place. This will likely be from the Local Planning Authority (LPA), although for larger or nationally significant developments, this would be sought from the UK or devolved government through the Development Consent Order (DCO) process in England, or the Development of National Significance (DNS) process in Wales.
Determining what constitutes "Development" and where the activity falls within the planning framework can be complex. We guide customers through the process, determining the nature of any works proposed and the consenting regimes under which approval should be sort.
Even if a planning permission is not necessary, other consents and authorisations may be required under other regimes either prior to work commencing, or prior to operations beginning on site. These include:
- Consent for works to listed buildings
- Approval of SuDS drainage designs
- Building Regulations approvals
- Environmental permits
- Consent for the storage and use of hazardous substances
- Consent to display advertisements
- Works to trees covered by Tree Protection Orders
